Bank of America N.A. v. Hermann Street DE, LLC: I was the point-person in protracted litigation arising from a commercial mortgage loan in the original principal amount of $132,000,000. The loan was secured by 16 apartment buildings. When the housing bubble burst, the borrowers defaulted, and the loan guarantors failed to honor their contractual guaranties. We obtained a court-appointed receiver to take possession and control of the apartment buildings, took title to all 16 buildings through non-judicial foreclosure, then pursued the guarantors for the loan deficiency. After a jury trial, a multi-million dollar verdict was entered against the guarantors, which I successfully enforced.
Borel Private Bank & Trust Company v. Hamrol: In a construction loan dispute arising from a failed condominium project, I successfully obtained a Right to Attach Order in the amount of $9,616,204. This elevated the lender’s claim to a secured position, giving it confidence to invest in the case and leverage to negotiate a favorable settlement.
Metalor Dental AG v. Warkentin: The exclusive U.S. distributor of a Swiss dental supply company failed to remit several hundred thousand dollars. I obtained judgment in the amount of $676,359.
Arrowood v. Maryland Casualty Company: We represented the defendant in this action for equitable contribution arising from a complex construction defect dispute. After a four-day bench trial, the Court returned a defense verdict. Plaintiff took nothing.
Yalter v. Endocare, Inc.: Plaintiff was seriously injured in a botched medical operation. After a confessed judgment and assignment of rights, he sued as a judgment creditor under a products liability policy. The matter was dismissed on my Rule 12 motion. Plaintiff appealed, but the appellate court affirmed the dismissal.
