Trust & Fiduciary Litigation

Trust litigation takes many forms, from disputes involving the validity of a trust instrument, to litigation in which the trust may be liable.  There are numerous issues that can arise in connection with the administration of a trust which may be resolved by seeking court approval of a particular course of action. 

However, a trustee may become involved in litigation.  A trustee may have to defend the trust from claims by third parties, sue on behalf of the trust or may be sued by a party interested in the trust.  Trustees are tasked with administering a trust solely in the interest of the beneficiaries.  If the trust has more than one beneficiary, the trustee has a duty to deal impartially with them, taking into account any differing interests.  Despite a trustee’s best efforts, beneficiaries may claim that the trustee failed to discharge his or her duties appropriately, or put the interests of one beneficiary above another.  In such cases, the trustee could be personally liable for damages.
