Insurance litigation concerns three primary practice areaa: Underwriting, coverage and bad faith.

 

Underwriting


Occasionally, a dispute will arise concerning the underwriting process, such the amount of premium due on a cancelled policy, or issues concerning premium financing.  More often, insurance disputes involve coverage issues and the implied covenant of good  faith and fair dealing.

 

Coverage

I have handled a wide-variety of insurance coverage issues over a broad spectrum of risk including auto, homeowners, construction, business, products liability, maritime, officers & directors, architects & engineers and trust administration.   I have the background and experience to tackle the most complex insurance coverage issues.

Bad Faith

Where a coverage issue cannot be resolved amicably, it often results in litigation.  When a coverage issue lands in litigation, the insurer’s motives and claims handling practices are invariably questioned. Insurance companies who refuse legitimate claims, suddenly deny coverage, or take an inordinate amount of time to pay a claim, may be liable for bad faith insurance practices. 

 

I have successfully handled many insurance disputes, for both policyholders and insurers.  I have the experience and skill to take a case to trial, with the good sense to resolve claims when appropriate.
